MADDEST PACKAGING DESIGN PROMOTION
TERMS AND CONDITIONS
Section 1 – Promotional Details:
1. Promoter: The Promoter is Mad Mex Fresh Mexican Grill Pty Ltd (ABN: 31 123 293 676) of Level 13, Suite 2, 50 Margaret Street, Sydney, NSW 2000.
2. Promotional Period: The Promotion will start at 9am AEST on 22/06/26 and end at 11:59pm AEST on 09/08/26.
3. Eligible Entrants: The Promotion is only open to Australian residents aged 15 or over (excluding SA residents). If an entrant is under 18 years of age, the entrant must have prior parental or guardian consent to enter.
4. Entry Instructions: Entrants must fully complete the following steps during the Promotional Period in order to enter the Promotion:
a. create a video or image demonstrating the most ‘mad way’ to serve the new Mad Mex fries (in accordance with the Design Criteria set out below); and
b. submit their entry for judging via one of the following avenues:
i. Facebook entry: post the video/image to the Promoter’s Facebook page (at https://www.facebook.com/madmex) with the hashtag #madmex OR send the video/image via a private message to the Mad Mex Facebook Messenger chat;
ii. Instagram entry: post the video/image on their Instagram page with the hashtag #madmex and tag @madmex;
iii. TikTok entry; post the video/image on their Tiktok page with the hashtag #madmex and tag @madmexau; or
iv. Website entry: visit madmex.com.au and follow the prompts to fully complete the entry form with the requested details and upload their video/image.
Entries uploaded via social media must meet any file format/size requirements of the applicable social media platform. Individuals who enter via Instagram/TikTok must also ensure their account privacy settings are set to ‘public’ to ensure the Promoter can access the video/image.
5. Design Criteria: All entries must meet the following Design Criteria:
a. entries can be in the form of any video or still image, and include photographs, drawings, sketches, illustrations, digital artworks, graphic designs, paintings, etc. Videos/images generated using AI will also be accepted;
b. entries must not demonstrate or depict excessive or unhealthy eating habits;
c. entries must not demonstrate unhygienic, unsafe or dangerous eating habits;
d. entries must not include any health related claims; and
e. entries must comply with the further requirements set out in Clause 24 below.
6. Number of Entries Permitted: Entrants can submit multiple entries, subject to the following:
a. each entry must be substantially unique; and
b. each entry must be completed as a separate submission in accordance with the entry instructions above and these Terms and Conditions.
7. Winner Determination Process: Entries will be judged by a panel of the Promoter’s representatives based on the originality, creativity and quality of the video/image submitted. Prizes will be distributed as set out below. The judges may select reserve winners in the case an entry or entrant is deemed invalid.
8. Prize Details: There will be one (1) major prize winer and one-hundred (100) minor prize winners selected in this Promotion. The prizes are as follows:
a. the best valid entry received during the Promotional Period overall (as determined by the judges) will win AU$20,000 (“First Prize”); and
b. the next best one-hundred (100) valid entries received during the Promotional Period (as determined by the judges) will win a year’s supply of Mad Mex fries valued at AU$405.60 (“Second Prize”).
9. Additional Prize Information: The following further details apply to the prizes on offer in this Promotion:
a. First Prize: The winner will be required to provide the details of an Australian bank account (in their name) to the Promoter in order for the prize to be awarded;
b. Second Prize: The prize consists of two (2) x small servings of Mad Mex fries per week for a year. The prize will be awarded via the Mad Mex app and does not include any further add-ons or customised elements. Winners will be required to download the Mad Mex app on a capable mobile device in order to redeem their prize (if they do not already have the app); and
c. General Conditions (applicable to all prizes):
i. In the case a prize is won by an entrant under the age of 18, the prize may be awarded to the entrant’s nominated parent or guardian.
10. Prize Limits: There is a limit of one (1) prize per entrant.
11. Total Prize Pool: The total prize pool is valued at AU$60,560.
12. Winner Notification: Winners will be notified via social media direct message (for those individauls who enter via Facebook, Instagram or TikTok) or by email/text (for those individauls who enter via the promotional website) within seven (7) days of being determined.
Section 2 – Further Terms:
1. By entering this Promotion, entrants confirm that they have read and understood these Terms and Conditions and agree to be bound by them. Entry into the Promotion is deemed to be acceptance of these Terms and Conditions.
2. Employees (and the immediate family members of such employees) of the Promoter and/or any agency or company directly associated with the Promoter or the conduct of the Promotion (including businesses involved in the determination of winners), management of the Promotion and suppliers/distributors) are not eligible to enter. “Immediate family member” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3. Where applicable, entries are deemed to be received at the time of receipt by the Promoter (and not at the time of submission or transmission by the entrant), based on the records of the Promoter (or its agencies).
4. There is no entry fee associated with this Promotion. However, entrants may incur standard costs associated with submitting an entry, including but not limited to internet access charges.
5. The Promoter may, at its discretion and at any stage of the Promotion, verify the validity of entries and confirm an entrant’s eligibility to participate, including by requesting evidence of identity, age, residency or any other information reasonably required for validation purposes. Entrants and winners must promptly provide any documentation or information requested for such purposes. If an entrant or winner is unable or unwilling to provide satisfactory evidence as requested, or if the Promoter reasonably believes that an entry is invalid or the entrant is not eligible, the Promoter may disqualify the entrant and/or deem any prize forfeited. In such circumstances, the Promoter is not obliged to award a replacement or substitute prize.
6. Incomplete, indecipherable, inaudible, incorrect or illegible entries (as applicable), as determined by the Promoter, acting reasonably, will be deemed invalid and not eligible to win any prize. The Promoter also reserves the right, acting reasonably, to invalidate any entry (or prize claim) that is not otherwise in accordance with these Terms and Conditions (including any entrant who has engaged in unlawful or improper conduct in submitting their entry).
7. Entries containing offensive or defamatory comments, or which breach any law or infringe any third-party rights, including intellectual property rights, are not eligible to win and may be invalidated at the Promoter’s discretion.
8. The use of any automated entry software, or any other mechanical or electronic means that enables an individual to automatically enter repeatedly, is strictly prohibited. The Promoter may, acting reasonably, invalidate all entries submitted by any individual who is found to have used such prohibited means.
9. If a winner does not accept, claim or take a prize within the reasonable time specified by the Promoter (or is unable to accept or take the prize for any reason), the prize will be forfeited and the Promoter is not obliged to provide any substitute prize or offer any form of compensation.
10. This Promotion is in no way sponsored, endorsed, administered by, or associated with any social media platform used in connection with the Promotion. Where applicable, entrants acknowledge that they are providing their information to the Promoter and not to any related social media platform. Any questions, comments or complaints regarding the Promotion must be directed to the Promoter and not to any related social media platform. Entry and continued participation in the Promotion is dependent on the entrant following and acting in accordance with the social media platform’s terms of use (available at http://instagram.com/legal/terms/ for Instagram, http://www.facebook.com/terms.php for Facebook and https://www.tiktok.com/legal/page/us/terms-of-service/en for TikTok). Where a promotional post is published as a sponsored advertisement, any entries via the sponsored advertisement will be considered valid and eligible for entry. Where applicable, entrants must ensure their account privacy settings are set to ‘public’ (i.e. not ‘private’) to ensure the Promoter can access and view their entry in the Promotion. By entering, entrants release Facebook, Instagram, TikTok and their related entities from any liability arising in connection with the Promotion, to the extent permitted by law.
11. The value of prizes on offer in this Promotion is accurate and where applicable, based on their recommended retail value (inclusive of GST) at the date of publication of these Terms and Conditions. The Promoter accepts no responsibility for any change in the value of such prizes after the date of publication.
12. No prize (or any part thereof) is exchangeable, transferable or redeemable for cash (or any other item), unless otherwise agreed in writing by the Promoter.
13. If a prize (or any part thereof) is not available despite the Promoter’s best efforts to procure the prize, the Promoter reserves the right to substitute the prize (or that part of the prize) with a prize of equal or greater value and/or specification.
14. Prizes will be awarded to the individual(s) identified by the Promoter as the winning entrant (based on the information submitted at the time of entry). Any entry that is made on behalf of another person or by a third party will be declared invalid. If there is any dispute regarding the identity of an entrant or winner, the Promoter reserves the right, acting reasonably and in its sole discretion, to determine the identity of the entrant or winner.
15. The Promoter retains the right to restrict a winner from taking or participating in certain aspects or the entirety of a prize if, in the Promoter’s reasonable judgment, the winner’s physical or mental condition may not allow for safe acceptance of or participation in the prize.
16. Winners (or their parent/legal guardian, if applicable) may be required to sign a legal release, as determined by the Promoter where reasonably required, before the prize is awarded.
17. Any prize provided by a third-party is subject to their terms, conditions, and requirements. The winner is responsible for reviewing and adhering to these conditions to ensure the full enjoyment of the prize. The Promoter is not liable for any issues, inconveniences or losses that may arise from the winner’s failure to comply with the third-party prize provider’s conditions, except as required by law. By accepting the prize, the winner agrees to comply with all conditions of use or taking the prize, as outlined by the third-party prize provider. To the extent of any inconsistency between these Terms and Conditions and the conditions of the prize supplier, the prize supplier’s conditions will prevail. This clause does not affect the winner’s rights under applicable consumer protection laws.
18. The Promoter will collect and use each entrant’s personal information for the purposes of conducting and administering the Promotion. This use may include verifying eligibility, communicating with entrants and awarding prizes. The Promoter may disclose personal information to its related entities, contractors, agents and prize suppliers. If an entrant does not provide the requested personal information, they may not be able to participate in the Promotion. By entering the Promotion, entrants acknowledge that their personal information will be handled in accordance with the Promoter’s privacy policy, available at https://www.madmex.com.au/privacy-policy/. The Promoter’s privacy policy contains information about how entrants may access, update or correct their personal information and how they may make a complaint regarding the handling of their personal information (and how such complaints will be dealt with).
19. Any guarantee or warranty provided is in addition to any applicable statutory guarantees and warranties. Nothing in these Terms and Conditions limits, excludes or alters, or is intended to limit, exclude, or alter any statutory consumer rights under any applicable laws, including the Competition and Consumer Act 2010 (Cth).
20. If, for any reason, any aspect of this Promotion is not capable of running as planned, including but not limited to cyber-attack, industrial strike, computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure, or any other cause beyond the control of the Promoter, the Promoter may, in its sole discretion, take any action it deems appropriate in relation to the Promotion, including cancelling, terminating, modifying or suspending the Promotion, invalidating any affected entries or suspending or modifying a prize. Where practicable, the Promoter will notify entrants of any cancellation, termination, modification, or suspension of the Promotion, or any suspension or modification of a prize, as soon as reasonably possible.
21. If there is a dispute concerning the conduct of the Promotion or the claiming of a prize, the Promoter will engage directly with the entrant to attempt to resolve the dispute. If the dispute cannot be resolved in this manner, the Promoter’s decision, acting reasonably and in good faith, will be final, subject to any applicable laws and regulations. Entrants acknowledge and agree that the Promoter’s decisions in relation to disputes are made in accordance with these Terms and Conditions.
22. The Promoter’s reasonable decisions regarding eligibility and validation of entries are final, subject to applicable laws and regulations.
23. To the extent permitted by law, the Promoter (and its associated agencies and companies) is not liable for any loss, cost, expense, damage, or liability suffered or incurred by any entrant or winner in connection with the Promotion, including in connection with late, lost, altered, damaged, or misdirected entries, or prize acceptance, delays due to technical disruptions or network congestion, incorrect or inaccurate information caused by equipment or programming associated with or utilised in the Promotion, theft, destruction, unauthorised access to or alteration of entries, or any use or acceptance of the prize. Nothing in this clause excludes or limits any liability to the extent it is caused or contributed to by the Promoter, or any liability that cannot lawfully be excluded or limited. To the extent permitted by law, any liability of the Promoter is limited to the minimum extent permitted by applicable law.
24. By submitting an entry in this Promotion, each entrant warrants that their entry, including any material, content or intellectual property contained therein (“Material”) submitted: (a) is their original work (or that they have obtained permission to use the Material in their entry); or (b) has been created by the entrant using lawful tools or technologies (including artificial intelligence or generative AI tools), and that the entrant has all rights, licences, permissions and consents necessary to submit the Material and grant the rights contemplated by these Terms and Conditions. The entrant further warrants that the Material does not infringe the intellectual property rights or other rights of any third party. Entrants hereby also declare that they have prior consent from any person featuring in the Material. Entrants grant the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, irrevocable, worldwide licence to use, reproduce, publish, modify, adapt, and communicate the Material for the purposes of conducting, promoting, and marketing the Promotion and the Promoter’s business (including its products), in any media, without further compensation, notification, or permission, except as required by law. Material must not contain anything that is offensive, defamatory, obscene, unlawful, discriminatory, or otherwise inappropriate, as determined by the Promoter in its sole discretion. Any Material submitted must not breach any law or regulation, or infringe any third party rights, including intellectual property rights, privacy rights, or moral rights. The Promoter reserves the right to remove, request removal or decline to publish or broadcast any Material (or part thereof) for any reason, including if the Material is in breach of these Terms and Conditions. Entrants hereby consent to any use of their Material that may otherwise infringe their moral rights. The Promoter reserves the right, at any time, to validate and check the authenticity of all Material submitted, including the originality and ownership of any Material. The Promoter reserves the right to disqualify any entry (or Material) that contains inappropriate content, or that breaches any law or infringes any third party rights. Entrants are solely responsible for the Material submitted as part of their entry. Entrants indemnify the Promoter against all claims, costs, losses, damages, and liabilities arising from or in connection with any breach of this clause, including any claim that the Material submitted infringes the rights of any third party or contains inappropriate content. The Promoter may, at its discretion, require entrants to provide evidence of ownership or rights to use any Material submitted as part of their entry.
25. The winners agree to participate in and cooperate with all reasonable marketing and editorial activities related to the Promotion. This may include, but is not limited to, being recorded, photographed, filmed, or interviewed. The winners also acknowledge that the Promoter may use such marketing and editorial material without the need for further reference or compensation.
26. The Promoter does not accept responsibility for any tax implications. Entrants are encouraged to seek independent financial advice to understand the tax implications associated with the prize or acceptance of the prize.
27. The Promoter’s decision not to enforce any of its rights at any given time should not be interpreted as a waiver of those rights.
